California has some of the broadest Fair Housing protections in the country, and San Diego landlords who aren’t up to speed are sitting on real legal and financial risk. Let’s talk about what you need to know.

More Protected Classes Than You Probably Realize

Federal law protects race, color, religion, national origin, sex, familial status, and disability. California goes further — significantly further.

In this state, you also cannot discriminate based on sexual orientation, gender identity, marital status, source of income (yes, that includes Section 8 vouchers), age, ancestry, and more. Getting caught on the wrong side of any of these isn’t just embarrassing — it’s expensive.

The Sneaky Violations That Catch Landlords Off Guard

Most Fair Housing violations aren’t intentional. They happen when a landlord:

  • Applies screening criteria inconsistently (stricter with some applicants than others)
  • Makes assumptions about a resident’s needs without asking
  • States a preference in a listing ad (even casually)
  • Fails to document their decision-making process

If you can’t show that you applied the same standards to every applicant, you have a problem.

Documentation Is Your Best Friend

Paper trails protect you. Every application decision, every communication, every maintenance request — document it. And keep those records for a minimum of three years.
